lingi Terms of Use
Effective from October 21, 2026. These terms cover what you get in the lingi app, what it costs, how to cancel and how to complain.
This is an English translation of the Polish Regulamin for readers who don't speak Polish. If the two versions differ, the Polish version prevails.
1. Who provides the service
- The lingi app is provided by Krzysztof Kraszewski (NIP 9552439000), "we" or "us".
- Contact: email contact@lingi.app. Send questions, complaints and the notices these terms mention to this address.
- These are the terms (regulamin) required by Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means. We publish them free of charge at lingi.app/terms before you enter into an agreement and at any time after. You can save and print them.
2. Definitions
- App: the lingi mobile app for iPhone.
- Service: everything we provide by electronic means through the App, described in section 3. Under the Polish Consumer Rights Act it is digital content and a digital service.
- You: the person using the App.
- Consumer: a natural person who enters into an agreement with us for purposes not directly related to their business or profession (Article 221 of the Polish Civil Code).
- Account: your lingi account. You sign in with a code sent to your email address or with Sign in with Apple.
- Subscription: an auto-renewing paid subscription to the Kurs or Kurs + Tutor plan, bought in the App through Apple's in-app purchase system.
- Tutor: the feature for spoken conversations in Spanish with a computer-generated partner.
- Tutor hour: a one-time in-app purchase ("1 godzina z Tutorem") that adds 60 minutes of Tutor conversations to your Account.
- Apple: Apple Inc. and its subsidiaries, including the company that runs the App Store in your country.
- Apple's licence: Apple's standard Licensed Application End User License Agreement, at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
3. What lingi offers
- lingi is an app for Polish speakers learning Spanish from Spain (es-ES). Explanations are in Polish or English.
- The App includes spaced-repetition flashcards, lessons, pronunciation checks, a placement test and spoken conversations with the Tutor, among other things. The App and its App Store page describe the current content and features.
- Your progress is saved on your phone. When you're signed in, we sync it with your Account so it works on more than one device and survives a reinstall.
- Full access to the course needs an active Subscription, including during a free trial. Without one, the App may offer only part of the content.
- Tutor conversations come with the Kurs + Tutor plan, on the terms in section 10.
4. Technical requirements
- You need an iPhone with an iOS version the App supports (the App Store lists the minimum) and an Apple ID to download the App and make purchases.
- You need an internet connection to download lessons, sign in, sync, buy, check pronunciation and talk to the Tutor. Flashcard reviews also work offline.
- Pronunciation checks and Tutor conversations need a microphone and your permission to use it in iOS settings.
- To sign in with a code you need an email address you can access.
- Your mobile operator charges for data under your own plan.
5. Security
- Using the internet carries the usual risks: malware, phishing, and someone taking over your email account or Apple ID.
- Only enter a sign-in code in the App. We never ask for that code or your Apple ID password by email, phone or message.
- Keep iOS and the App up to date, and don't hand a phone that's signed in to people you don't trust.
6. Account and age
- The Account is free. You create it in the App by signing in with a code sent to your email address or with Sign in with Apple.
- You need an Account to talk to the Tutor, to buy Tutor hours, and to back up and sync your progress.
- The Account is personal. Don't share it, and keep control of your email inbox.
- People aged 16 or over can use the App on their own. Anyone younger may use the App and create an Account only with the consent of a parent or legal guardian.
- A minor may buy a Subscription or a Tutor hour only with the consent of a parent or legal guardian, unless the law lets them enter into that agreement on their own. Parents can restrict purchases in Apple's settings.
7. Entering into and ending the agreement
- The agreement for the Service starts when you begin using the App. The agreement for the Account starts when you create the Account. Both run for an indefinite period and are free.
- The agreement for a Subscription or a Tutor hour starts when you confirm the purchase in Apple's purchase sheet. A Subscription runs for the period you paid for (a month or a year) and renews automatically under section 9.
- You can stop using the App and delete it at any time. To delete your Account, go to Settings, Delete account in the App. We then delete the Account and its data from our server; progress saved on the phone stays. Deleting the Account ends the agreement for the Account.
- Deleting the Account or the App does not cancel a Subscription, because Apple manages it. Cancel it as described in section 9.3.
- Bought Tutor minutes are stored on the Account. Once the Account is deleted they can't be used or moved.
- We may terminate the agreement for good cause, meaning a serious or persistent breach of these terms (section 11), with 14 days' notice. If the breach involves providing unlawful content or threatens the security of the Service or other people, we may terminate with immediate effect. We'll give the reason in an email to the Account's address.
- If we stop providing the Service altogether, we'll tell you at least 30 days in advance. For a paid Subscription period you haven't used, we'll refund a proportional part of the price unless Apple refunds it.
8. Plans, prices and the free trial
- Kurs: the full course in the App, 24,99 zł a month or 199,99 zł a year.
- Kurs + Tutor: everything in Kurs plus Tutor conversations (120 minutes in every month of the Subscription, section 10), 49,99 zł a month or 399,99 zł a year.
- Tutor hour: 60 minutes of Tutor conversations, 19,99 zł, paid once.
- These prices apply in the Polish App Store and include VAT. Prices and currency may differ in other countries. The price shown in the App and in Apple's purchase sheet before you confirm is the one that applies.
- New subscribers get a free trial: 2 weeks on annual plans and 1 week on monthly plans. Apple grants one free trial per Apple ID across all lingi plans.
- After the trial the Subscription becomes paid and Apple charges you, unless you cancel at least 24 hours before the trial ends. If you allow notifications, the App reminds you 2 days before the trial ends.
- You can redeem Apple offer codes in the App (I have a code) or in the App Store. The terms given with the code apply.
9. Payment, renewal, changing plans and cancelling
- Apple handles purchases in the App (In-App Purchase). Apple charges the payment method linked to your Apple ID on its own terms. We never see or store your card details.
- A Subscription renews automatically for the same period at the current price unless you cancel at least 24 hours before the current period ends. Apple charges for the next period within the 24 hours before it starts.
- To cancel, open iOS Settings, tap your name (Apple ID), then Subscriptions. You can also get there from the App: Profile, Subscription, Manage subscription. After you cancel, you keep access until the end of the period you paid for and Apple charges nothing more. Cancelling alone doesn't refund the current period (refunds are covered in sections 14 and 16).
- You can change plans in the App (Profile, Subscription, Change plan) or in iOS subscription settings. Apple decides when the change takes effect, under its own rules. Moving to a higher plan, such as from Kurs to Kurs + Tutor, or from monthly to annual on the same plan, starts at once, and Apple refunds the unused part of the old plan. Moving to a lower plan starts at the next renewal.
- We may change the Subscription price for future periods for good reason: changes in taxes, in the cost of providing the Service, or in its scope. A new price never applies to a period you've already paid for. Apple tells you about the change and, where Apple's rules or the law require, asks for your consent. If you don't accept the new price, cancel before the renewal.
- If Apple can't take a payment, it may retry for a while. During that time your access to the course may continue or be paused, depending on Apple's rules.
- When a Subscription ends, studying in the App is locked but your progress stays. Settings, data export and account deletion remain available. When you resubscribe, you pick up where you left off.
- To get a Subscription bought on your Apple ID onto another device, tap Restore purchases. When you're signed in, the Subscription also links to your Account.
10. Tutor conversations and Tutor hours
- The Tutor is a conversation partner generated by a computer using artificial intelligence, not a person. It helps you practise speaking, but it isn't a certified teacher, doesn't run exams and doesn't issue certificates or attestations.
- The Tutor's replies, corrections and summaries are generated automatically and can contain mistakes. Treat them as a learning aid. Don't base medical, legal or financial decisions on them.
- Tutor conversations need an Account, an internet connection and a microphone.
- The Kurs + Tutor plan includes 120 minutes of conversation in every month of the Subscription. A month counts from the day the Subscription was bought or renewed; on an annual plan, from the same day of each following month. Unused minutes don't carry over to the next month.
- During a free trial you get 30 minutes of conversation in total for the whole trial.
- We count the time from the start to the end of each conversation, as our server records it. You choose the length of a conversation in the App. If you have less time left, the conversation is shorter and ends with a short wrap-up. A new conversation can't start with less than 3 minutes left.
- You can buy a Tutor hour in the App when you're signed in and have an active Kurs + Tutor plan, including during a free trial. Each purchase adds 60 minutes to your Account.
- Bought minutes don't expire. They're stored on your Account, so they work on any device where you sign in. The App uses them only after that month's included minutes are gone.
- You can use bought minutes only while the Kurs + Tutor plan is active. If the plan ends or you switch to Kurs, the minutes wait on your Account until you have Kurs + Tutor again.
- If Apple refunds a Tutor hour, we remove its unused minutes from your Account. If Apple refunds a Subscription, the monthly minutes from that Subscription end, and bought minutes stay.
11. Rules of use
- Use the App lawfully, in line with these terms and with common decency.
- You must not provide unlawful content, including in Tutor conversations and in messages to us. This covers in particular content that incites violence or hatred, infringes other people's personal rights or copyright, or sexual content involving minors.
-
In particular, you must not:
- use the Tutor to produce unlawful, abusive or harmful content, or to harass,
- try to get around the Tutor's safeguards or make it reveal its instructions, configuration or other details of how it works,
- access the App or the Service by automated means (bots, scripts) or bulk-download course content,
- get around limits, safeguards or payments,
- disrupt the App or our servers, or interfere with the App's code beyond what the law allows,
- share your Account or resell access to the Service.
- If you break these rules, we may end a conversation, restrict access to the Tutor for a time and, for a serious or persistent breach, terminate the agreement (section 7.6). We'll tell you why unless the law forbids it. You can appeal the decision the same way as a complaint (section 15).
12. Course content and licence
- The content in the App (vocabulary, sentences, recordings, episodes, texts, graphics, software, and the lingi name and logo) is protected by law. The rights belong to us or our licensors.
- For the duration of the agreement you get a non-exclusive, non-transferable licence to use this content in the App for your own learning, for non-commercial purposes. Apple's licence also governs the licence to the App itself as software (section 19).
- Without our permission you must not copy, bulk-download, distribute, sell or publish course content, except where the law permits it.
- What you create (answers, what you say in conversations, saved sentences) stays yours. We process it only as far as needed to provide the Service, for example so the Tutor can reply and prepare a summary.
- You can download a copy of your data in the App: Settings, Export data.
13. Personal data
The controller of your data is Krzysztof Kraszewski (NIP 9552439000). The privacy policy explains how we process it.
14. Conformity of the Service and updates
- We're responsible for the Service conforming with the agreement for as long as we provide it, under Articles 43h to 43q of the Polish Consumer Rights Act of 30 May 2014.
- We provide App updates, including security updates, needed to keep it in conformity. We publish them in the App Store. If you don't install an update within a reasonable time, we're not responsible for a lack of conformity caused solely by that, as long as we told you about the update and what happens if you don't install it.
- If the Service doesn't conform, you can ask us to bring it into conformity. If we don't do that within a reasonable time, refuse, or the lack of conformity is serious enough to justify it without a repair first, you can ask for a price reduction or withdraw from the agreement. You can't withdraw if you pay for the Service and the lack of conformity is minor.
- We'll refund what you're owed because of a price reduction or withdrawal without undue delay, and no later than 14 days after we receive your notice, unless Apple refunds it.
- We may also change the Service when that's not needed for conformity, for good reason: new or changed features, changes in technology, in the law or in Apple's rules, or security. Such changes cost you nothing. If a change significantly and negatively affects your access to the paid part of the Service, we'll tell you in advance by email to the Account's address, and you may terminate the agreement within 30 days of the change or of our notice about it, whichever is later. We'll then refund a proportional part of the price for the period after the change.
- We may make short technical breaks. We announce longer ones in the App whenever we can.
15. Complaints and disputes
- Send a complaint by email to contact@lingi.app. Describe the problem, when it happened and what you'd like us to do. If you have an Account, include its email address; it speeds things up.
- We reply by email within 14 days of receiving the complaint. If a consumer gets no reply within that time, the complaint is deemed accepted.
- Apple handles payment issues, such as an unwanted or double charge. You can file a request at reportaproblem.apple.com. You can also write to us and we'll help.
- If you're a consumer in Poland, you can get free help from your municipal or district consumer ombudsman (rzecznik konsumentów), or ask the regional Trade Inspection (Inspekcja Handlowa) for mediation or for a ruling by its permanent consumer arbitration court. The Office of Competition and Consumer Protection (UOKiK) publishes information about these options and the bodies that run them at uokik.gov.pl. We decide case by case whether to take part in such a procedure. You don't have to use these options before going to court.
16. Right of withdrawal
- A consumer may withdraw from an agreement made at a distance without giving a reason within 14 days of entering into it.
- It's enough to send us a notice at contact@lingi.app or file a refund request with Apple at reportaproblem.apple.com before the 14 days are up. You can use the model form at the end of these terms, but you don't have to.
- You lose the right of withdrawal if, before the 14 days are up, you expressly agree to us starting to provide the content or service and acknowledge that you lose the right by doing so. This applies to digital content we've started to supply and to services we've fully performed (Article 38(1)(1) and (13) of the Polish Consumer Rights Act). You'll receive confirmation of the agreement on a durable medium, for example by email.
- Apple takes the payment for in-app purchases, so Apple usually makes the refund, on its own terms. If you withdraw validly and Apple doesn't refund you, we'll refund you ourselves without undue delay, and no later than 14 days after we receive your notice.
- After withdrawing you may no longer use the content covered by the agreement. Also cancel the Subscription with Apple (section 9.3) so it doesn't renew.
17. Sole traders with consumer protection
We apply the consumer rules on unfair contract terms, the right of withdrawal and the conformity of digital content and services to a natural person who enters into an agreement directly related to their business, where the agreement shows it isn't of a professional nature for them. That follows in particular from the scope of their business as shown in CEIDG, the Polish business register (Article 3855 of the Polish Civil Code, Articles 7aa and 38a of the Polish Consumer Rights Act).
18. Liability
- We work to keep the Service running well, but we don't promise you'll reach a particular level or pass an exam. That depends on your study. The estimated level in the App is a guide.
- Towards consumers we're liable under the general rules. Nothing in these terms excludes or limits liability that the law doesn't allow to be excluded or limited, in particular for a lack of conformity of the Service and for damage caused intentionally.
- We're not liable for damage caused by things we're not responsible for, such as failures on Apple's side, your network operator's side or your device, sharing your Account with others, or using the Service against these terms.
- Towards businesses without the protection in section 17, we're not liable for lost profits, and our liability is limited to the amount paid for the Service in the last 12 months. This limit doesn't apply to damage caused intentionally.
19. Apple and Apple's licence
- You download the App from the App Store. Apple's licence (the Licensed Application End User License Agreement) governs your licence to use the App as software. It applies alongside these terms: Apple's licence to the licence for the App, and these terms to the Service, the Account, Subscriptions and the Tutor. Neither document limits consumer rights under mandatory law.
- These terms and Apple's licence are an agreement between you and us, not Apple. We, not Apple, are responsible for the App, its content and the Service.
- Apple has no obligation to maintain or support the App. We provide support (section 1.2).
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Your rights against us under section 14 remain.
- We, not Apple, handle claims relating to the App, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection and data protection claims, and claims that it infringes a third party's intellectual property rights.
- When using the App, comply with any third-party terms that bind you, such as your network operator's.
- Apple and its subsidiaries are third-party beneficiaries of this agreement (Article 393 of the Polish Civil Code). When you accept these terms, Apple has the right to enforce them against you, and is deemed to have accepted that right.
20. Changes to these terms
- We may change these terms for good reason: changes in the law, decisions or rulings that affect us, changes in Apple's rules, changes in the scope or way we provide the Service, new features, or to improve security.
- We announce a change at least 14 days before it takes effect, in the App and by email to your Account's address if you have one. If the law requires a change sooner, we make it within the time the law requires.
- If you don't accept a change, you can end the agreement before it takes effect by deleting your Account and cancelling your Subscription. A Subscription period you've paid for and bought Tutor minutes are settled under the previous terms.
21. Governing law and courts
- Polish law governs the agreements. If you're a consumer living in another country, you keep the protection of that country's mandatory law.
- Disputes with consumers go to the court that has jurisdiction under the general rules. Nothing in these terms limits a consumer's legal right to choose a court.
- Disputes with businesses without the protection in section 17 go to the court for the place where we run our business.
22. Final provisions
- These terms apply from October 21, 2026.
- The Polish version of these terms is binding. This English version is a translation for readers who don't speak Polish.
- If any provision turns out to be invalid, the rest still apply.
